Model of mediation agreement

«For the settlement of any disputes arising out of or in connection with this contract, including any question relating to its existence, validity, interpretation, performance or termination, the parties agree and undertake to submit them to the Mediation Service of the Madrid International Arbitration Centre – Ibero-American Arbitration Center (“CIAM-CIAR” or “Centre”), in accordance with its Rules in force at the date of submission of the request for mediation. The mediation shall be conducted by [number of mediators]. The place of the mediation shall be [city] and the language shall be [language]».

Model of med-arb agreement

«For the resolution of any disputes arising out of or in connection with this contract, including any question relating to its existence, validity, interpretation, performance or termination, the parties agree and undertake to submit them to the Mediation Service of the Madrid International Arbitration Centre – Ibero-American Arbitration Center (“CIAM-CIAR” or “Centre”), in accordance with its Rules in force on the date of submission of the request for mediation.

In case of failure to settle the disputes under the said Rules within [*] days after the Request for Mediation has been admitted for processing by the Center, or upon expiration of any other period of time expressly agreed by the parties, such disputes shall be finally settled by arbitration administered by CIAM-CIAR in accordance with its Rules in effect on the date of filing of the Request for Arbitration.
